These Terms of Service (“Terms” or “Agreement”) govern your access to and use of the Fokus email management service (the “Service”), provided by Omiwato Ventures AB (“Fokus,” “we,” “us,” or “our”). By using or accessing the Service, you acknowledge that you have read, understand, and agree to be bound by these Terms.
If you are entering into these Terms on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms. If you do not agree with these Terms or do not have such authority, you must not use the Service.

2.1 Purpose
Fokus provides an email management tool (the “Product”) designed to filter unwanted
marketing, sales, and promotional emails, and otherwise help users organize their inboxes.
The Product may be accessible through various domains and subdomains controlled by us
(collectively, the “Website”).
2.2 Features & Limitations
While we strive for a high level of accuracy, the AI-driven nature of the Product means there is a
risk of false positives or false negatives. We disclaim liability for any misclassification of
emails, including the accidental filtering of important messages or the failure to filter unwanted
communications. You acknowledge that you remain responsible for periodically reviewing your
filtered emails.

We reserve the right, at our sole discretion, to suspend or terminate your access to the Service
if we determine that your use violates these Terms or otherwise harms our interests, other users,
or the general public.
4.1 Paid Service
Fokus is a paid subscription service. From time to time, we may offer free trials at our sole
discretion. If you choose to subscribe or continue using the Service after a trial period ends, you
will be charged according to the subscription plan you select.
4.2 Refund Policy
All subscription payments are non-refundable, except where required by mandatory consumer
protection laws in your jurisdiction. We do not issue refunds or credits for partial subscription
periods or unused features.
4.3 Payment Processing
Payments for the Service are processed by third-party payment providers, such as Stripe. By
subscribing to the Service, you agree to abide by the payment provider’s terms of service and
privacy policy. We are not responsible for any errors, fees, or issues arising from the payment
process.
5.1 Ownership
All content, features, and functionality of the Service (including software, code, text, graphics,
images, design, arrangement, and compilation) are owned by us or our licensors, and are
protected by Swedish and international copyright, trademark, patent, trade secret, and other
intellectual property laws.
5.2 License Grant
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license
to access and use the Service for your personal or internal business purposes. You may not
reproduce, distribute, modify, or create derivative works of any part of the Service without our
express written permission.
THE SERVICE AND ALL RELATED CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE, OUR AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OR DIRECTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, REGARDLESS OF LEGAL THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.
8.1 Governing Law
These Terms, and any dispute or claim arising out of or in connection with them or their subject
matter or formation (including non-contractual disputes or claims), shall be governed by and
construed in accordance with Swedish law, without regard to its conflict of law principles.
8.2 Arbitration
Any dispute, controversy, or claim arising out of or in connection with these Terms, or the breach,
termination, or invalidity thereof, shall be finally settled by arbitration administered by the
Stockholm Chamber of Commerce (or another reputable arbitral institution in Sweden) in
accordance with its rules. The seat of arbitration shall be Stockholm, Sweden, and the language of
the arbitration shall be English (unless otherwise agreed by the parties).
We may revise and update these Terms from time to time at our sole discretion. Changes become effective immediately upon posting, unless otherwise stated. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
10.1 User Data Deletion
In accordance with applicable data protection regulations (including the GDPR), you have the
right to request deletion of your personal data at any time. Upon receiving a valid request, we will
permanently remove your data from our systems unless we are required by law to retain it.

Your use of the Service is also governed by our Privacy Policy, which is incorporated herein by
reference. Please review our Privacy Policy for details on how we collect, store, process, and
protect your personal data.
You may terminate your use of the Service by canceling your subscription and/or ceasing to access the Website. Upon termination, you remain responsible for any outstanding fees or charges incurred prior to termination.
These Terms, together with any referenced policies (such as our Privacy Policy), constitute the entire agreement between you and us regarding your use of the Service and supersede any prior or contemporaneous understandings or agreements, whether written or oral.
By using Fokus, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you are not authorized to access or use the Service.
